An arrest is disorienting, for the person being arrested and for the family watching it unfold.
The First Hours After an Arrest: What You Need to Know
An arrest can be overwhelming for both the person arrested and their family. In the confusion, it’s easy to say or sign something that may affect the case later. Knowing your rights is essential.
Know Your Rights
Under South African law, you have the right to:
- Remain silent: You only need to confirm your identity. Do not answer questions without legal advice.
- Be informed of your rights: The police must explain these rights clearly.
- Consult a lawyer: Speak to an attorney before making a statement, signing documents or agreeing to anything.
Don’t Handle It Alone
Do not try to “clear things up” yourself. The legal process has specific procedures and timelines.
- Don’t make statements without an attorney present.
- Don’t sign anything you don’t understand.
- Don’t make assumptions about how bail works.
- Do find out what the allegations are and what happens next.
An Accusation Is Not a Conviction
Being arrested or accused does not mean you are guilty. You have the right to understand and challenge the case against you, and to be properly represented.
